Brain-Reading Devices Raise Ethical Concerns as UNESCO Proposes Global Guidelines

Delegates at a United Nations meeting hosted by UNESCO in Paris have released the world’s first global recommendations aimed at safeguarding mental privacy and user rights in brain-interface technologies.

The guidelines emerge amid rapid advances in brain-reading devices, such as the brain implant that enabled stroke survivor Ann Johnson to vocalize through an avatar in 2022. Devices like these—developed by academic teams and companies such as Neuralink—are capable of modifying neural activity to aid functions like movement, speech, and sensory feedback. While such technologies offer promising medical breakthroughs, they also raise urgent questions around data privacy, consent, and potential misuse.

The newly proposed ethical framework outlines nine core principles that emphasize the protection of human rights, particularly in relation to autonomy, freedom of thought, and informed consent. The recommendations call for full transparency in how neural data is collected and used, and urge developers to assess and disclose any long-term mental health impacts of their technologies.

“This document clarifies how to protect human rights, especially in relation to the nervous system,” said Pedro Maldonado, a neuroscientist at the University of Chile and one of 24 experts involved in drafting the guidelines.

Although the recommendations are not legally binding, they are intended to serve as a foundation for national and international policymaking. UNESCO’s 194 member states are expected to vote on their adoption in November.

The meeting addressed both invasive and non-invasive neurotechnologies used across fields including medicine, education, and entertainment. While medical brain-computer interfaces are already subject to regulation in regions like the United States and the European Union, consumer-grade wearables remain largely unregulated. This lack of oversight is concerning given their scalability and potential for data exploitation, according to Nataliya Kosmyna, a neurotechnologist at MIT who contributed to the draft.

Particular concern was raised over the use of neurotechnology in educational settings, where the guidelines recommend prohibiting its use to evaluate student or teacher performance—practices that could reinforce social or academic inequalities.

Delegates also warned against the covert use of neural data for commercial or political purposes. Non-invasive devices could infer sensitive brain information from indicators such as eye movement or voice tone, potentially enabling neuromarketing tactics that manipulate behavior without consent—even during unconscious states like sleep.

“These devices already pose risks to mental privacy,” said Marcello Ienca, an ethicist at the Technical University of Munich. “Data about the brain and mind should be treated with heightened protections.”

The guidelines stress that consent must be “prior, free and informed,” with users retaining the right to withdraw at any point. But some experts question whether informed consent alone is sufficient. Vikram Bhargava, a technology ethicist at George Washington University, noted that neural data may reveal not only personal information but also insights into others who share similar neural patterns.

Still, others maintain that social and environmental factors play a larger role in cognitive patterns than neural similarity. “The similarities in the way people think relate more to where they live, how they live, rather than how their brains operate,” Maldonado argued.

Legal scholar Nita Farahany of Duke University welcomed the guidelines as a powerful step toward establishing global norms but cautioned that policy alone may not be enough. “Countries should push developers to build safeguards directly into the design of neurotechnology,” she said, citing trends toward deregulation in other sectors such as artificial intelligence.

As the race to decode the human brain accelerates, the UNESCO guidelines aim to ensure that mental autonomy and dignity are not left behind.
