The Accident

The annals of aviation history are punctuated by tragic instances of mid-air collisions between civil and military aircraft, particularly within the United States and Europe. These incidents not only underscore the inherent risks of shared airspace but also highlight the imperative for stringent regulatory frameworks and robust communication protocols to mitigate such occurrences.

Mid-air collisions between civil and military aircraft serve as stark reminders of the complexities inherent in managing shared airspace. They underscore the imperative for continuous evaluation and enhancement of aviation safety protocols, robust communication channels between civil and military aviation entities, and the diligent enforcement of established regulations. Through such concerted efforts, the aviation community can strive to prevent the recurrence of such tragedies and ensure the safety of all airspace users.

A poignant example is the recent catastrophe near Washington, D.C., on January 31, 2025. An American Airlines passenger jet, en route from Kansas, collided mid-air with a U.S. Army Black Hawk helicopter. This calamity resulted in the loss of all 67 individuals aboard both aircraft, marking it as the deadliest aviation disaster in the United States in over two decades. Preliminary reports suggest that the helicopter may have been operating at an altitude higher than authorized, potentially contributing to the collision. The National Transportation Safety Board (NTSB) has initiated a comprehensive investigation to ascertain the precise causative factors.

It is too early in the investigative process to determine responsibility and accountability. However, the accident makes one reflect.

Past Accidents and Incidents

Reflecting on historical precedents, the 1988 Remscheid incident in West Germany remains etched in collective memory. On December 8 of that year, a U.S. Air Force A-10 Thunderbolt II, engaged in low-altitude training, crashed into a residential area in Remscheid. The mishap claimed the lives of the pilot and six civilians, with fifty others sustaining injuries. Investigations attributed the accident to spatial disorientation experienced by the pilot amidst adverse weather conditions. This tragedy underscored the perils associated with military training flights over densely populated regions.

In the realm of near-miss incidents, a notable event occurred on September 19, 2024. United Airlines Flight 2428, descending towards San Francisco International Airport, executed an abrupt maneuver to evade a potential mid-air collision. This sudden action, prompted by the aircraft’s Traffic Collision Avoidance System (TCAS), resulted in injuries to two passengers. The Federal Aviation Administration (FAA) launched an inquiry into the incident, emphasizing the critical role of TCAS in modern aviation safety.

Internationally, on August 14, 2024, two French Rafale military jets collided mid-air during a training exercise in eastern France. The mishap led to the disappearance of at least one pilot and a possible passenger, while another pilot was located and reported safe. French Defense Minister Sébastien Lecornu confirmed the incident, and rescue operations were promptly initiated. This event highlighted the inherent risks associated with military training exercises and underscored the necessity for rigorous safety protocols.

These incidents, among others, have precipitated comprehensive investigations by aviation authorities such as the NTSB and the FAA. The findings from these inquiries have been instrumental in shaping policies aimed at preventing future occurrences. For instance, the recent collision near Washington, D.C., has prompted discussions regarding the establishment of restricted zones for helicopter operations in proximity to major airports. Such measures are indicative of a proactive approach to aviation safety, seeking to mitigate risks associated with shared airspace.

United States Regulations

The delineation of military-designated airspace within the sovereign airspace of the United States is predicated upon a sophisticated regulatory framework codified under Title 14 of the Code of Federal Regulations (CFR), which establishes distinct airspace classifications for military operations. These classifications, encompassing Military Operations Areas (MOAs), Restricted Areas, and Warning Areas, are subject to specific regulatory constraints and oversight mechanisms designed to ensure both the integrity of military flight operations and the preservation of civilian air navigation interests. The Federal Aviation Administration (FAA), in collaboration with the Department of Defense (DoD), exercises jurisdictional oversight and interagency coordination to harmonize military operational imperatives with civilian aviation exigencies, thereby maintaining both national security and the efficient utilization of airspace resources.

An aviation occurrence involving a commercial air transport aircraft and a military aircraft necessitates a comprehensive investigation into the allocation, utilization, and operational intersection of military and civilian airspace. Given that military flight operations frequently take place in proximity to controlled civilian airspace, the imperative of stringent coordination protocols cannot be overstated. Air traffic controllers serve a critical function in ensuring separation and preventing airspace incursions, effectuating real-time deconfliction measures and enforcing compliance with airspace designations. The occurrence of such a midair collision may be indicative of procedural non-compliance, systemic deficiencies in interagency coordination, or an inadvertent deviation from prescribed operational norms.

The discretionary authority vested in air traffic controllers concerning the operation of military rotary-wing aircraft within the approach and landing corridors of civil aerodromes is contingent upon a multiplicity of regulatory determinants, including airspace classification, operational imperatives, and strict adherence to established aeronautical procedures. Controlled airspace surrounding aerodromes is subject to exacting regulatory scrutiny, with approach and landing trajectories meticulously delineated to mitigate operational risk. The ingress of military helicopters into these critical flight phases, absent an overriding operational justification, is proscribed unless explicitly authorized, contingent upon assurances that aviation safety will not be compromised.

Aviation accidents and incidents involving the intersection of military and civilian aircraft underscore the necessity of a resilient and adaptive air traffic management architecture, underpinned by real-time interagency coordination, unwavering procedural adherence, and the integration of advanced surveillance and communication technologies. While military flight operations constitute an indispensable component of national defense, their seamless integration into the civilian airspace framework necessitates a calibrated and legally coherent approach that ensures an equitable balance between security imperatives and aviation safety. The progressive evolution of air traffic control technologies, coupled with an adaptive regulatory oversight framework, remains imperative in precluding future occurrences and upholding the enduring integrity and security of the national airspace system.

My Take

Although the air crash in January 2025 in Washington DC was a domestic accident within the United States and will be governed by law and regulations of the United States , countries could benefit from the international perspective in aviation – as an analogy –  for guidance offered under the auspices  of the International Civil Aviation Organization. 

From an aeronautical standpoint, Annex 11 to the Chicago Convention—dedicated to Air Traffic Services—sets forth a crucial framework for the coordination of activities that may pose a hazard to civil aviation. The International Standards and Recommended Practices encapsulated within Chapter 2 of the Annex emphasize the necessity for close cooperation between military authorities and air traffic services (ATS). These provisions prescribe that ATS authorities must not only establish but also maintain a continuous and structured dialogue with military entities responsible for operations that have the potential to impinge upon the safety and efficiency of civil aircraft operations.

The overarching objective of these provisions is clear: to achieve a harmonized operational environment wherein activities hazardous to civil aircraft are carefully coordinated with ATS authorities. This is done with a view toward ensuring the optimal allocation of airspace that minimizes interference with normal civil aviation operations while simultaneously safeguarding the safety of flight. Of particular relevance in this regard is Standard 2.17.1, which mandates that arrangements concerning activities with inherent risks to civil aviation—whether within a State’s sovereign airspace or over international airspace—must be subject to early and effective coordination with ATS authorities. This provision is intended to allow for the timely dissemination of pertinent aeronautical information in accordance with the requirements set out in Annex 15, which governs Aeronautical Information Services. The requirement is further reinforced by Standard 2.17.2, which reaffirms that such coordination should be aimed at achieving the most effective arrangements possible to mitigate hazards to civil aircraft while minimizing disruptions to their routine operations.

However, it is essential to recognize the broader legal context in which these provisions operate. Article 89 of the Chicago Convention provides that, in the event of war or a national emergency, the Convention’s provisions, including its Annexes, shall not constrain the sovereign prerogatives of ICAO Member States, whether they find themselves in a state of belligerency or neutrality. Historical precedents serve to illustrate the manner in which States have invoked Article 89 to restrict or prohibit certain civil aviation activities. A notable example is the notification given by Egypt in 1949 upon Israel’s accession to the Convention, wherein Egypt advised ICAO that, due to its state of war with Israel, Israeli aircraft could not claim overflight privileges within Egyptian airspace. A similar stance was adopted by Iraq, which declared a state of emergency in 1948 and consequently restricted Israeli overflights. India, in 1962, likewise invoked Article 89 to notify ICAO that, due to external aggression from the People’s Republic of China, it might be unable to comply with all provisions of the Chicago Convention. Similarly, in 1965, Pakistan declared a state of emergency under Article 89, thereby reaffirming that national security considerations could, at times, override obligations derived from the Convention. In each of these cases, ICAO acted as a conduit for communication, ensuring that all Member States were apprised of the declarations made under Article 89.

Beyond these considerations of sovereignty and safety, the imperative of civil-military coordination in airspace management extends beyond mere airspace sharing. Rather, it necessitates an efficient and equitable allocation of airspace for both civil and military users, particularly in relation to military flights that traverse civilian air routes en route to or from designated special-use airspace. The inescapable conclusion is that a structured and formalized coordination mechanism between military authorities and air navigation service providers is not merely desirable—it is essential.

This necessity was underscored at the Global Air Traffic Management Forum on Civil and Military Cooperation convened by ICAO on 19 October 2009. At this forum, the International Air Transport Association (IATA) advanced the proposition that airspace should be managed as a singular, unified continuum, rather than a fragmented patchwork of segregated areas. This holistic approach, IATA argued, would necessitate a minimization of restrictions placed on airspace users, thus calling for a systematic and structured approach to managing airspace access and duration of use.

Similarly, the Civil Air Navigation Services Organisation (CANSO) highlighted the mounting pressures placed on finite airspace resources as a result of increasing civil air traffic. CANSO, in advocating for a cooperative approach, stressed that the linchpins of successful civil-military coordination are trust, transparency, mutual respect, and flexibility among all stakeholders. Furthermore, CANSO emphasized the importance of a regional, rather than purely national, approach to airspace management, citing the European Organization for the Safety of Air Navigation (EUROCONTROL) as an exemplar of a true civil-military organization, where both civil and military stakeholders are integrated at the policy-making level. The ultimate goal, according to CANSO, is the establishment of a fully integrated global air traffic management (ATM) system that fosters seamless collaboration between civil and military partners at the national, regional, and international levels.

Against this backdrop, it becomes evident that the future of airspace management must be predicated upon principles of shared responsibility and cooperative engagement between civil and military aviation stakeholders. The challenges posed by growing air traffic demand, coupled with the strategic imperatives of national defense, necessitate a paradigm shift toward a model of integrated, rather than segregated, airspace management. In this respect, ICAO’s framework, as set forth in Annex 11 and reinforced by the deliberations of international aviation stakeholders, provides a compelling blueprint for the evolution of airspace governance in the 21st century.
